Your Rights Under Title VI

Title VI is a statute provision of the Civil Rights Act of 1964. Title VI (Sec. 601) of the Civil Rights Act of 1964 provides: "No person in the United States shall on the grounds of race, color or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance.” (42 U.S.C. Sec. 2000d)

What does this mean?

Nondiscrimination provisions apply to all programs and activities of recipients and subrecipients of federal financial assistance.

Furthermore, any person eligible to receive benefits or services from the Department of the Treasury or its recipients is entitled to those benefits or services without being subject to prohibited discrimination. The City of Moreno Valley is a recipient of federal funds through the Department of Treasury.

If a person believes s/he has been subjected to discrimination and/or reprisal because of membership in a protected group then that person may file a complaint with the City of Moreno Valley’s Human Resources Division Manager and/or the Treasury Department’s Office of Civil Rights and Diversity.

Discrimination prohibited on the grounds of race, color, or national origin:

  • Deny a person any service, financial aid, or other benefit provided under the program;
  • Provide any service, financial aid, or other benefit to a person which is different,
    or is provided in a different manner, from that provided to others under the program;
  • Subject a person to segregation or separate treatment in any matter related to his receipt of any service, financial aid, or other benefit under the program;
  • Restrict a person in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any service, financial aid, or other benefit under the program;
  • Treat a person differently from others in determining whether he satisfies any admission, enrollment, quota, eligibility, membership, or other requirement or condition which persons must meet in order to be provided any service, financial aid, or other benefit provided under the program;
  • Deny a person an opportunity to participate in the program through the provision of services or otherwise to afford him an opportunity to do so which is different from that afforded others under the program; or
  • Deny a person the opportunity to participate as a member of a planning, advisory, or similar body which is an integral part of the program.

How to file a Title VI discrimination complaint

Complainants will receive a written response acknowledging receipt of the complaint. The Human Resources Division Manager will review the complaint and investigate it as quickly as possible. A written notice of findings will be provided upon completion of the investigation. Notice of findings shall be issued within 30 days.

Parties dissatisfied with the final decision of the City of Moreno Valley’s Human Resources Division Manager may submit their complaint to the U.S Department of Treasury at the address below no later than 180 days after the date of the alleged discrimination, unless the time for filing is extended by U.S Department of Treasury.

Timeliness
The City of Moreno Valley shall conclude Title VI complaint investigations within 30 days of filing, and provide a written response to the complainant.

The U.S Department of Treasury Office of Civil Rights and Diversity has authority to investigate actions that took place no more than 180 days prior to the filing of your complaint, unless a waiver of this filing is requested and granted.
